Website Terms of Use
These Terms of Use govern your access to and use of the openwidedental.ca website. They do not govern use of the OpenWide platform itself, which is subject to separate agreements.
1. Acceptance of These Terms
By accessing or using the openwidedental.ca website (the "Website"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Website. The Website is operated by Marion LLB Inc., a corporation incorporated in Canada, operating as OpenWide ("OpenWide," "we," "us").
2. About the OpenWide Platform
The Website provides general information about the OpenWide dental patient experience platform. Use of the platform itself — including the patient portal and the practice-facing tools — is governed by separate agreements: subscription agreements between OpenWide and subscribing dental practices, and the terms and consents presented to patients within the portal.
Nothing on this Website creates a subscription, a care relationship, or any other agreement between you and OpenWide. Subscribing dental practices remain the health information custodians of their patients' health records at all times. For information about how we handle personal information, see our Privacy Policy.
3. Not Dental or Medical Advice
The content on this Website is provided for general informational purposes only. It is not dental, medical, or other professional advice, and it is not a substitute for the advice of a qualified dental professional. Always consult your dental practice or another qualified health provider with any questions about your oral health or a dental condition. Never disregard professional advice, or delay seeking it, because of something you have read on this Website.
4. Product Information and Demonstrations
Screenshots, demonstrations, sample summaries, statistics, and product descriptions on this Website are illustrative. They may include simulated or example content, and they may not reflect the current state of the platform. Features, functionality, and availability are subject to change without notice, and nothing on this Website constitutes a commitment to deliver any particular feature or result.
5. Intellectual Property
The Website and its content — including the OpenWide name, logo, wordmark, text, graphics, designs, and software — are owned by Marion LLB Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view, download, and print content from the Website for your own personal or internal business reference. Any other use, including reproduction, modification, distribution, or republication, requires our prior written permission.
6. Acceptable Use
When using the Website, you agree not to:
- use the Website for any unlawful purpose or in violation of any applicable law;
- attempt to gain unauthorized access to any systems, accounts, or data connected to the Website or the OpenWide platform;
- interfere with or disrupt the operation of the Website, including by introducing malicious code or placing an unreasonable load on our infrastructure; or
- scrape, harvest, or systematically extract content or data from the Website without our prior written permission.
7. Disclaimer of Warranties
The Website is provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that its content is accurate, complete, or current.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Marion LLB Inc. and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Website. Your sole and exclusive remedy for any dissatisfaction with the Website is to stop using it.
9. Changes to These Terms
We may update these Terms of Use from time to time. The current version and its effective date are shown at the top of this page. Your continued use of the Website after an updated version takes effect constitutes acceptance of the revised terms.
10. Governing Law
These Terms of Use are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these terms or the Website will be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
